The law on phones and driving
It is illegal to hold and use a phone, sat nav, tablet or any device that sends or receives data while driving or riding a motorcycle in the UK. The law covers far more than calls — taking a photograph, scrolling a playlist or checking a message all count, and it applies when you are stopped at lights or queuing in traffic, not just when moving.
The penalty is 6 penalty points and a £200 fine. Drivers who passed their test within the last two years lose their licence at 6 points, so a single offence can mean starting again. In more serious cases the matter can go to court, where the fine can be considerably higher and a disqualification is possible.
A phone can be used hands-free — through a Bluetooth headset, a voice command, a windscreen or dashboard holder, or a built-in vehicle system — provided the device is not held at any point and you remain in proper control of the vehicle. Police can still stop a driver who is not in control even when the phone is in a cradle.
A hands-free kit connects a phone to the vehicle so calls run through the speakers with a microphone positioned to pick up the driver clearly. On vehicles without a factory Bluetooth system, this is usually the simplest way to make a car compliant and considerably less distracting to use.
Common questions
Hands-free questions
Can I use my phone hands-free while driving?
Yes, provided you never hold the device and stay in full control of the vehicle. You can still be prosecuted for not being in proper control even if the phone is in a holder.
What is the penalty for using a handheld phone?
Six penalty points and a £200 fine. Drivers within two years of passing their test lose their licence at six points.
Can I use my phone when stopped in traffic?
No. The law applies whenever you are in charge of the vehicle on the road, including while queuing or waiting at lights with the engine running.
What if my car has no Bluetooth?
A hands-free kit can be fitted to most vehicles, routing calls through the speakers with a separate microphone so you never need to touch the handset.
